The City of Duarte is expected to repeal its sex offender ordinance, according to a letter from City Attorney Dan Slater dated April 30. According to that letter, the actions are the result of “a threat” from California RSOL to sue the City if it did not repeal its ordinance.
The City Attorney noted in his letter the California Supreme Court decision dated April 23, 2014, which denied review of two decisions by the Court of Appeal which determined that offender laws by cities, similar to that adopted by Duarte, were preempted by state law. The letter further stated, “given that we will be promptly presenting the repeal ordinance to the City Council, we trust you will take no action to initiate litigation against the City seeking repeal of the ordinance.”
“The City of Duarte is to be commended for its wise decision to repeal its ordinance,” stated CA RSOL president Janice Bellucci. “Due to its wise decision, the City will not be sued.”
Wise choice by Duarte.
One of the things that I’ve been wanting to do is to create a packet that we can provide for cities to use to assist their citizens on ACTUAL, proactive methods to prevent child predation. While it’s always satisfying when a city repeals ordinances, the ability to provide sound, proactive solutions and methods would be as important (to the citizens) as the actual repeal of the ordinance itself.
Perhaps we can start a collaboration on this project.

It’s getting to the point that we are able to actually see which city attorneys, district attorneys, city council members, etc actually have common sense by their reaction and what they do with the letters they get from CA-RSOL. City Attorney Dan Slater obviously has a good head on his shoulders; then there are the ones like the king of dumbness his self, the ever honorable, obstinate, ill informed, twister of truth, Tony Rackauckas. It’s getting rather humorous listening to their statements after Janice gives them a much needed and well deserved information spanking that reminds them that they are not as special as they think they are and that they, too, are required to abide by state law. ★
